CreonixMedia are crooks - site rip

The ripoff site - http://www.creonixmedia.com (I've archived their site for posterity)

The original - http://www.equentity.com

They even took every word of our content! Check out "Meet the Owners." They used our descriptions for themselves!

The big problem for them is that all of our images are digitally watermarked. Their site has our name written all over it, and they have no idea (yet). Obviously, we have C&D letters prepared, and we are copying GNAX, Getty Images (since they are showing our royalty-purchased imagery illegally), and preparing a load of documentation should we require legal intervention.

Has anyone here ever used these guys, know these guys, or have any information on them? I tried calling them, but got a voice message system. I'll try again tomorrow.

Write up a D&C - I'll share ours with you. Send it to them and their upstream provider.

Even though its only 80 words, is it still worth it?

Bloody hell. Talk about blatant!

They've even left your name in at least one place aswell as using all your content and design:

"This partnership ensures we can continue to provide a superior level of service for our customers, and do so with the same degree of quality, speed and care they have come to expect," said Hirsch, Owner/Partner of Creonix Media.
Really sorry to see this Paul. Hope they take the site down right away (should be clear to their host that it's completely stolen I'm sure if they don't take it down themselves).

We'll be taking steps to contact them and the other parties who need to be informed tomorrow. I just learnt that WHT member "Sailor" is the owner of GNAX, which seems to be hosting their site, so I may get in touch with him.

Our names are all over the place on the site, John. I outlined some in the core team forums earlier today. Here are a few of my favourites:

http://www.creonixmedia.com/about/ow...#GregoryHarrop

I love the way they change the first name, but not the surname. I'm now called Gregory.

Quote:
Harrop, Hirsch and Riddick's first joint project was the creation of the CMX Developments , an open network of Web professionals, hobbyists and enthusiasts sharing knowledge and a passion for Web design, launched in November, 2003. Talks began soon thereafter about the possibility of a merger, and many months of planning and preparation have led up to this official announcement. While Creonix Media has been a legal entity since May 22, 2005, the announcement coincides with the launch of its own online presence.
Apparently they couldn't be bothered changing the names in the press release, but decided they could be bothered to replace "International Web Developers Network" with their company name. Hey, maybe IWDN needed a new name.

I started developing Web sites on a corporate scale in 2002, when I officially became a freelancer trading under the company name WY Media here in the BVI.
I thought I was the one who started developing sites on a corporate scale in 2002, when I became a freelancer trading under the name WY Media. Give them some credit, they changed "West Yorkshire" to British Virgin Islands.

Oh and John... there's no need to be sorry.

Pauly is quite taken a back by it. It's his first blatant site rip. Site ripping seems to mark a moment in a designers life like no other.

Besides, you all know how laid back us three like to be.

Oh yea I'm quite pleased in a sense that one of my designs was ripped, Jamie & Paul had their fair share of input too! I definately think it's something to be proud of the first time round, it's definately something to mark on your career timeline

Thanks Simon. Perhaps you could take a peek at the one I made (two parts template to one part original spiciness), and see what you think:

http://www.creonixmedia.net/

Oh yeah, http://www.creonixmediasucks.com/ will take you to that page as well!

If you visit these sites (they go to the same location), please click the link to their site, so their traffic logs will cal attention to our efforts. Thanks

Oh, I tried to make the cease-and-desist part as easy to understand as possible. If you only read the bold parts, you'll still understand the entire message.

Quote:
Quoting The Complete Cease and Desist Order:
It has come to our attention that you have made unauthorized use of copyrighted work, namely the Web site design for Equentity LLC (hereafter referred to as "the Work"), in the preparation of your site, creonixmedia.com. Rights to our work are fully reserved, which was first published in 2005 on http://www.equentity.com.

Your work entitled CreonixMedia.com and which appears on your Web site at http://www.creonixmedia.com, is essentially identical to the Work and clearly used the Work as its basis. We have archived key components of your Web site for scrutiny by authorities, and we are in the process of contacting Getty Images, the providers of our visual imagery, so they may take action against you for illegal use of their photos. In addition, we have archived content you have used verbatim from the Work, and areas in which you are currently displaying our digital signature, all of which is being delivered as evidence to the parties listed at the end of this correspondence.

You neither asked for nor received permission to use the Work as the basis for CreonixMedia.com, nor to make or distribute copies of it. Therefore, we believe you have willfully infringed our rights under 17 USC Section 101, et seq. and could be liable for statutory damages as high as $100,000.

We demand that you immediately cease the use and distribution of all infringing works derived from the Work, and all copies of it, and that you deliver to us all unused, undistributed copies of it, or destroy such copies immediately, and that you desist from this or any other infringement of our rights in the future. If we have not received an affirmative response from you by Friday, April 28, 2006, indicating that you have fully complied with these requirements, we shall consider taking the full legal remedies available to rectify this situation.

Sincerely,

We tried to make it such that a child could understand it, since it is entirely possible...

Fantastic, Danny. I really should have thought of that myself. Tjobbe used StyleGala for his little "Mozilla Bought IE" April Fools joke and it worked a treat.
